NOTICE IS HEREBY GIVEN that a public hearing will be held on Tuesday, April 14, 2026 at 12:00 p.m. at the Imperial County Air Pollution Control District (ICAPCD) located at 150 South 9th St., El Centro, CA 92243. The purpose of this hearing is to consider a request by Hudson Ranch Power I, LLC, for their geothermal power plant facility located at 409 W. McDonald Road in Calipatria, CA, for a modification to Regular Variance 03-25REG. The submitted application, 03-25REG-MOD, seeks a modification of the increments of progress and final compliance date for Regular Variance 03-25REG. Regular Variance 03-25REG was issued for Permit Conditions 11, 12, 13, and 14 of Permit to Operate (PTO) No. 4233A, which pertain to the nitrogen oxides (NOx) emission limits and source test requirements of three emergency generators at the facility. The Permit Conditions are listed below: 

 

11.      The diesel engine of each black start emergency generator shall not exceed the emission limit of 28.58 pounds per hour of NOx emissions.

 

12.      The diesel engine of the emergency standby generator shall not exceed the emission limit of 11.93 pounds per hour of NOx emissions.

 

13.      The diesel engine of each listed black start emergency generator shall be source tested for compliance with the emission limits of Condition 11 within the first 60 days of installation and every three (3) years thereafter. The frequency of source testing may be extended to not less than every 60 months for each black start emergency generator under the following conditions:

 

a.        Each black start generator operates less than 500 hours per 12 month period (as demonstrated by operational logs) and which emit less than 5 tons of NOx per 12 month period. This period may be extended if a source can prove that the each black start generator has not been operated during the calendar year.

 

b.        Each black start generator uses a portable NOx analyzer to take a NOx emission reading to verify compliance with Condition 11 during each quarter in which a source test is not performed. The portable analyzer shall be calibrated and used per Air District Rule 400.3.G.2.b.

Pursuant to Rule 206 of the Imperial County Air Pollution Control District (ICAPCD) Rules and Regulations, the Air Pollution Control Officer (APCO) has made a preliminary decision to grant an Authority to Construct Permit to El Toro Land & Cattle for the development of a new cattle feedyard located at 910 Nichols Road, El Centro, California. In accordance with ICAPCD Rule 206, Section C.3 (Processing of Applications), a 30-day public notification is required when project emissions exceed the applicable pounds-per-day threshold for any fugitive emissions. This project is expected to exceed those thresholds for particulate matter (PM₁₀) and volatile organic compound (VOC) emissions. Authority to Construct Permit No. 4822 will include conditions designed to ensure compliance with all applicable ICAPCD rules and requirements.

 

The Public has an opportunity to submit comments on the proposed permit. Written comments regarding the proposed decision will be received by the ICAPCD for a period of thirty (30) days after publication of this notice. The closing date for comments will be March 29, 2026. RULE 310 OPERATIONAL DEVELOPMENT FEE

ANNUAL ACCOUNTABILITY REPORT FY 2023-2024

On November 6, 2007, the Imperial County Air Pollution Control District Board of Directors adopted Rule 310 Operational Development Fee as a mechanism to help mitigate air impacts resulting from the operation of new commercial and residential developments in Imperial County. Redistribution of collected funds during a given fiscal year provide a sound method for emission reduction projects throughout Imperial County.

 

Section E.7 of Rule 310 requires the ICAPCD to prepare and publish on August 1st of each calendar year an annual accountability report which discloses the total

amount of off-site fees received; total monies spent; total monies remaining; a list of all projects funded; total emissions reductions realized; and the overall cost-effectiveness factor for the projects funded. The published report covers fiscal year 2023-2024.
